Time sharing and parenting plans

With changing family dynamics and means of communication, Florida abandoned the terms child custody and visitation in 2008. The state believes that both parents should have access to their children and remain involved in their children's lives, so unless one party is deemed unfit, divorcing parents must agree to time sharing schedules and parenting plans. Time sharing schedules state the time each child spends with a parent, including weekends, holidays, and with whom the child will primarily live. A parenting plan includes the time-sharing schedule and documents the relationships and interactions between each parent and their children, particularly regarding decisions to be made on the child's behalf such as:

  • Schooling and child care
  • Religious decisions
  • Health insurance
  • Communication methods between parent and child
  • Travel and transportation
  • Any other necessary provision

Paternity issues

Paternity is critical in determining the rights and obligations of a man regarding his alleged children. Paternity actions can be initiated by a man who believes, or is believed to be, the father of a child, a woman who is pregnant or has a child, or by a child who wishes to determine paternity. There are five ways to establish paternity:

  • Marriage
  • Court order
  • Legitimation
  • Written acknowledgement of paternity
  • Genetic testing and administrative order
